A precondition for the issuing of a parking fine by a private parking control company is that there is clear guidance in the area about the terms and conditions of parking, and that the company can show proof that the driver has contravened such guidance.
You are entitled to request that a parking fine be cancelled if
- the signage in the parking area has been insufficient: for example, the parking regulations to be followed in the area and the consequences of violating them were not clearly displayed in the parking area.
- the vehicle was not parked in breach of the signage
- the person to whom the parking fine was issued was not the driver responsible for incorrect parking.
If you make a complaint regarding the fine, you have the right not to pay the fine until the complaint has been processed. If the complaint is dismissed, you have the right to a clear justification for the dismissal.
The collection company used by the parking control company may not collect the fine until the complaint has been processed. If the company undertakes collection measures before the fairness of the parking fine has been reviewed, you may issue a complaint on this both to the company and the collection company used.
