A package tour contract does not bind the traveller until the traveller has paid a booking fee.
If you have not yet paid the booking fee, the tour operator cannot ask for any payment for cancelling the trip.
If you have paid the booking fee, according to the Package Tour Act and general package tour terms and conditions, you can usually cancel the trip in the following situations:
No specific reason: If you cancel the trip for no reason, the charges will be higher the later you cancel the trip. By paying the administration costs, a package tour can usually be cancelled 28 days before the trip. After that, the amount to be paid will increase.
Force majeure: If you cannot travel because of an unexpected and serious incident: for example, if you yourself, a fellow traveller or a close relative becomes ill, you can cancel the trip by paying the administration costs.
Health or other safety risk: If there are reasonable grounds to believe that the trip cannot take place without endangering a traveller´s life or health, you can cancel the trip and claim the price of the trip and other fees paid to the tour operator. The tour operator does not have to compensate the traveller for any costs incurred due to cancellation or for other damages. A justified reason is, for example, when a relevant authority recommends travel restrictions.
Changes made by the tour operator: If the tour operator has substantially increased the price or made changes in the travel arrangements, you can cancel the trip and claim the price of the trip and compensation for expenses incurred which, on account of the cancellation, have become superfluous.
Special terms and conditions can differ from general terms and conditions
Due to the special nature of the trip the tour operator can use cancellation rights which differ from the general package tour terms and conditions, for instance because of the circumstances in the country of destination, or because regular flights are being used.
Special terms and conditions must include information about circumstances when the traveller who cancels the trip has to pay the fees which an airline, hotel or other service provider has collected from the tour operator.
Insurance can provide additional security for cancellation situations
Expenses due to cancellation of the trip can be avoided with voluntary travel insurance. It is advisable to check at the booking stage what kind of cancellation protection insurance is included in the travel insurance.
