Amendments to the terms of the subscription contract

Notifying the consumer of amendments to contract terms

The operator shall inform the consumer of any amendments to the contract terms and the content of the amended terms no later than one month before the amended terms become effective.

The terms of subscription contracts can only be amended if there are legitimate grounds for their amendment.

Fixed-term contracts may only be amended in exceptional cases

The operator may not amend the terms of a fixed-term subscription contract, during the contract period, to the detriment of the consumer. If the operator announces amendments to the contract terms to the detriment of the user, the customer has the right to terminate the subscription contract with immediate effect.

However, the amendment of contract terms is allowed if the need for their amendment is due to changes in legislation or decisions taken by the authorities. For instance, if an amendment to the contract terms is due to changes in tax legislation, the subscriber is not entitled to terminate a fixed-term communication service contract.

Amendments to an ongoing contract

The operator may also amend the terms relating to an ongoing contract to the detriment of the consumer, but only in the following cases:

  1. On the grounds identified in the contract terms, if the content of the contract is not fundamentally changed as a whole.
  2. On the basis of a change in legislation or a decision taken by the authorities.

In addition, the operator may make minor amendments to the contract terms, as long as these amendments do not affect the main content of the contract.

The consumer may terminate an ongoing contract due to amendments to the contract. In such a case, the amended terms shall not apply to the consumer during the period of notice. The subscriber is entitled to terminate a communication service contract with immediate effect if the telecom operator announces an amendment to the contract terms to the detriment of the subscriber.
