A package tour contract does not bind the traveller until the traveller has paid a booking fee. If the booking fee has not been paid the tour operator cannot ask for any payment for cancelling the trip.
If the booking fee has been paid, according to the Package Tour Act the traveller and the general package tour terms and condition can cancel the trip as follows:
- Because of a force majeure: i.e. the traveller cannot travel because he/she has met with an unexpected and serious incident. If the traveller, fellow traveller or close relative becomes ill or for another such reason the trip can be cancelled by paying the administration costs.
- Because of the situation at the destination, i.e. if the traveller has a justified reason to believe that the trip cannot take place without endangering the traveller's life or health. A justified reason is, for example, the one when authorities think it justified to recommend travelling restrictions.
- Because of changes made by the tour operator, if the tour operator has substantially increased the price or made changes in travel arrangements.
In addition to the above, on trips which comply with the general package tour terms and conditions, the traveller can cancel the trip for no reason, in which case charges will increase the later the traveller cancels the trip.
The tour operator must be notified about the cancellation as soon as possible.
